SSDI Payments Were Unreported Household Income

LVT Number: #22364

Landlord sued to evict Section 8 tenant for violating the terms of her lease. Landlord claimed that tenant failed to notify landlord that she received additional income in the form of Social Security Disability Insurance (SSDI) payments to her infant son. Tenant asked the court to dismiss the case. She argued that her son's disability payments should be excluded in calculating her annual household income. The court ruled against tenant. The son's SSDI payments should be considered additional income.
