Right to Sublet Garage Space

Landlord asked the DHCR to explain the rules governing landlord's and tenant's rights to sublet rent-stabilized garage space. The DHCR told landlord that the rules differ, depending on whether the garage space is an ancillary service included in the rent. When the garage space is included in the rent, landlord can't unreasonably withhold its consent to sublet. But if the garage space is rented separately, landlord can limit the sublet to a maximum of two years.
