Garage Spaces and Waiting List

Tenant asked the DHCR if landlord cooperative building could limit the rental of garage spaces to co-op shareholders only or use a waiting list for assigning spaces. In an opinion letter, the DHCR stated that if, prior to the co-op conversion, the landlord had provided garage spaces to tenants, this was a required service that couldn't now be limited. Similarly, the right to be placed on a waiting list is a required service if that practice had been used before the co-op conversion.
