Garage Spaces Subject to Rent Stabilization Code

Tenant asked the DHCR if his garage space was subject to rent stabilization. Prior landlord had registered the garage space as a service in the initial 1984 registration of rents and services, and this ancillary service wasn't provided by an independent contractor. New landlord wanted to raise the garage space rents to market rents. In an opinion letter, the DHCR stated that the building's garage spaces were subject to rent stabilization under these circumstances.

If landlord refused to offer garage leases, tenants could complain to the DHCR and get garage rent freezes.
