‘Respondent' Was Former Super

DOS issued a violation notice that named Wing Check Yee as the respondent. Landlord claimed the notice was invalid because Yee was a former building super. The ALJ ruled against landlord and fined him $50. Landlord appealed. ECB ruled for landlord and revoked the fine. The violation notice was dated June 11, 1994, and landlord showed that Yee hadn't been the building's super or representative since June 1993. So Yee wasn't the super on the date the violation notice was issued.
