Super's Affidavit Didn't Show Reasonable Cleaning Efforts

DOS issued a violation notice to landlord for not sweeping 18 inches into the street. Landlord's super submitted an affidavit stating that he swept at 1:00 a.m. and saw none of the mentioned litter when he left the building at 10:00 a.m. and saw the violation notice. The ALJ ruled against landlord and fined it $50. Landlord appealed and lost. Landlord didn't show any regular cleaning schedule, and the inspector who issued the violation notice found debris along the curb. So landlord didn't prove reasonable cleaning efforts were made.
