Landlord applied for MCI rent hikes based on the replacement of parapet walls. The DRA ruled against landlord because landlord got a prior MCI increase for parapet work. Landlord appealed. Landlord had previously gotten MCI increases for pointing and waterproofing. At that time, certain areas of the parapets had to be removed and rebuilt in connection with the MCI installation. The DHCR ruled for landlord in part. Landlord now had fully replaced the parapet walls.

The DHCR ruled for landlord in part. Landlord now had fully replaced the parapet walls. The DHCR granted an increase for the full replacement, minus the cost of that portion of the parapet walls that were previously removed and rebuilt in connection with the pointing and waterproofing.
