Replacement of Gas Main Doesn't Qualify

Mt. Vernon landlord applied for MCI rent hikes, based on the replacement of the building's gas main. The DRA denied the application, and landlord appealed. The DHCR upheld the DRA's ruling. Replacing a gas main from the street to the building line doesn't qualify for an MCI because it doesn't involve structural changes or the replacement of a major building system.
