New Water Main Doesn't Qualify

Landlord applied for MCI rent increases based on the installation of a new water main costing $2,000. The DRA ruled against landlord, and landlord appealed. Landlord claimed that the new water-main pipe was copper, and replaced an old lead pipe that was hazardous to health. The DHCR ruled that a new water main doesn't qualify as an MCI unless it's installed in conjunction with new building-wide plumbing or re-piping. Landlord's PAR was denied.
