Reconditioned Stove Was Defective

Rent-stabilized tenant complained of a reduction in services based on a defective stove. The DRA ruled for tenant and reduced her rent. Landlord appealed and lost. Although tenant wanted a new stove, landlord had given her a reconditioned one. HPD also had inspected the stove and found no violations. Landlord claimed that on the DHCR inspection date, tenant's stove was in working condition. But the DHCR's inspector found that the inside of the stovetop had severe rust stains and was deteriorating.
