Rear Stairway Doesn't Qualify

Landlord applied for MCI rent increases based on the installation of a steel stairway from the lobby to the rear yard of its building. The DRA ruled against landlord and landlord appealed. Landlord claimed that the new steel stairway was required for access to the garbage disposal area. The DHCR ruled against landlord. Replacement of the rear stairs wasn't a ìmajorî capital improvement absent a showing that all exterior stairs had been replaced. The work done was only repairs.
