Prior Parapet Work Didn't Include Pointing and Waterproofing

Landlord applied for MCI rent hikes based on pointing and waterproofing a building facade. The DHCR ruled against landlord, finding that landlord previously obtained a 2006 MCI increase for the same work. Landlord appealed, claiming that the DHCR's decision was arbitrary and unreasonable. The DHCR then took the case back for reconsideration and ruled for landlord. Detailed review of the record showed that the prior parapet installation didn't include pointing and waterproofing work. The DHCR had mistakenly determined that it did.
