Portion of Architect's Fee Included in Apartment Improvement Rent Increase

Tenant complained of a rent overcharge. Landlord claimed that it had made apartment improvements costing more than $28,000. The DRA allowed some rent increase for the apartment improvements costing $17,000 and found there was some rent overcharge. Landlord appealed, and won in part. The DRA had disallowed any rent increase for architect's fees costing $4,100. Landlord argued that he needed the architect to get permits for the apartment renovation work.

Landlord was granted a rent increase for a prorated portion of the architect's fees equal to 36 percent of landlord's claimed costs, or $1,476.
