Partial Parapet Wall Replacement Doesn't Qualify as MCI

Landlord applied for MCI rent hikes based on parapet wall replacement and exterior waterproofing. The DRA ruled against landlord, finding that all parapets on the building weren't replaced and the exterior waterproofing didn't include pointing. Landlord appealed and lost. Landlord claimed that complete parapet replacement wasn't necessary. But a partial parapet wall doesn't qualify as an MCI. And waterproofing, by itself, doesn't qualify as an MCI.
