No Increase for Sheetrock

Tenant complained of a rent overcharge. The DRA ruled for tenant and imposed triple damages for a willful overcharge. Landlord appealed, claiming that it had made apartment improvements and should have been granted a 1/40th rent increase. The DHCR ruled against landlord. The work done by landlord was repairs and maintenance. Among other things, landlord claimed that it had installed Sheetrock in the apartment. But the installation of Sheetrock doesn't qualify as an apartment improvement unless it is installed in most of an apartment.
