Tenant complained of a rent overcharge. The DRA ruled against tenant, finding no overcharge. Tenant appealed. The DRA had granted a 1/40th increase for various apartment improvements. Tenant argued that the DRA should have disallowed any increase for Sheetrock. The DHCR ruled against tenant. Although Sheetrock wasn't done throughout the apartment, it was needed for the creation of a wall in the bathroom, between the sink and the bathtub, and for the installation of a new shower body. So the Sheetrock qualified as an apartment improvement.
