No Increase for New Tile Floor in Lobby

Landlord applied for MCI rent hikes based on a lobby/hallway renovation. The DRA ruled against landlord, and landlord appealed, arguing that it had renovated the entire lobby tile floor. The DHCR again ruled against landlord. Landlord's renovation of the lobby floor was repair and maintenance work. It didn't qualify as an MCI.
