No Increase for Lawn Sprinkler System and Drains

Landlord applied for MCI rent increases based on the installation in a housing complex of yard drains, catch basins, water wells, landscaping, and lawn sprinkler systems. The DRA ruled against landlord, and landlord appealed. The DHCR ruled against landlord. Since the work done consisted of storm water drainage improvements to the grounds outside the buildings, it wasn't required for the operation, preservation, and maintenance of the structures. So the work didn't qualify as an MCI.
