Landlord applied for MCI rent hikes based on complex-wide installation of concrete, landscaping, and sprinkler systems. The DRA ruled for landlord. Tenants appealed, claiming that the landscaping and sprinkler systems didn't help the structural integrity of the building and so didn't qualify as MCIs. The DHCR ruled against tenants. Under the Rent Stabilization Code, as revised in 2000, the DHCR's policy is to grant MCI increases for landscaping and sprinklers if done in connection with qualifying MCIs.
