The DRA gave landlord a 1/40th rent increase for apartment improvements costing $25,000 but disallowed additional improvements costing $18,000 because the work was deemed general maintenance and repair work. Landlord appealed. The DRA ruled for landlord in part. Landlord was entitled to a 1/40th increase for $3,800 spent on the installation of new concrete subflooring in the kitchen and the upgrading of the kitchen and bathroom floor tiles. This reduced the total amount of the overcharge.
