Installation of New Sub-Floor Tiles

Landlord asked the DHCR if the cost of buying and installing either linoleum or vinyl floor tiles qualifies for a 1/40th individual apartment improvement rent increase. In an opinion letter, the DHCR said that replacement of tiles alone may be deemed ordinary repairs and maintenance. But it's the DHCR's policy that installation of new subflooring in addition to new tiles may qualify for a 1/40th rent increase.
