Wall Tiles Installed Only Around Bathtub

Tenant complained of a rent overcharge. The DRA ruled for tenant and ordered landlord to refund $3,700, including triple damages. Tenant appealed. The DRA had granted landlord some rent increase for individual apartment improvement consisting of installation of bathroom tiles. Tenant claimed that prior landlord installed the tiles only around the bathtub. The DHCR ruled for tenant. The wall tiles were installed only around the bathtub---the rest of the bathroom wall tiles remained untouched. So no rent increase was allowed for this item. The total overcharge was increased to $13,700.
