The DRA ruled that landlord didn't file a 1984 fuel cost report on time and revoked the cumulative fuel cost adjustments for that year. Landlord appealed, claiming that the prior landlord completed and delivered the fuel cost forms to tenants and that it was only four days late in submitting the required copy to the DHCR. The DHCR ruled against landlord.

The DRA ruled that landlord didn't file a 1984 fuel cost report on time and revoked the cumulative fuel cost adjustments for that year. Landlord appealed, claiming that the prior landlord completed and delivered the fuel cost forms to tenants and that it was only four days late in submitting the required copy to the DHCR. The DHCR ruled against landlord. Although the Office of Rent Control, DHCR's predecessor agency, had accepted late filings in the past and the DHCR continued to do so for a few years after 1984, it was no longer DHCR's policy to accept late filings based on substantial compliance.
