Landlord Used Paper Bags as Garbage Receptacles

DOS issued a violation notice to landlord after finding household garbage overflowing from paper shopping bags placed in the trash collection area. Landlord claimed he used paper bags because DOS had broken and crushed one of four new metal garbage cans he'd recently bought. The ALJ ruled against landlord, since the law barred use of paper bags as trash receptacles, and fined him $50. Landlord appealed, claiming that the paper bags were placed behind a fence and had been further placed in plastic bags which were broken into. ECB ruled against landlord.
