Landlord Claims Garbage Bags Belonged to Tenant

DOS issued a violation notice to landlord for leaving 10 50-gallon trash bags at curbside on a noncollection day. Landlord claimed that a tenant who was moving out had left bags of clothing on the sidewalk. The ALJ ruled against landlord and fined it $200. Landlord appealed and lost. Landlord submitted no documentation or other proof of its claim. So it was reasonable to conclude that the bags contained garbage and had been placed out for collection.
