Landlord Claims Cats Tore Open Garbage Bags

DOS issued a violation notice to landlord for having a dirty sidewalk area in front of his building. Landlord claimed that there had been no garbage collection for six days and that cats tore open the garbage bags and scattered the trash. The ALJ ruled against landlord and fined him $50. Landlord appealed and lost. Landlord was responsible for maintaining the area in front of the building no matter what caused the litter to accumulate.
