Landlord Removed Pigeon Roost

Tenant complained of reduced services. He claimed that pigeons roosting in the decorative iron balcony of the above apartment were loud and dirtied tenant's air conditioner and windows. It took landlord three months to gain access to the above apartment, but landlord did clean out the pigeon roost. The DRA therefore dismissed tenant's complaint. Tenant appealed, claiming that he should get a rent cut for the three months between the time landlord got notice of tenant's complaint and the time landlord corrected the problem. The DHCR denied tenant's PAR.

Landlord promptly made numerous requests for access to remove the pigeon roost, and tenant acknowledged that the problem had been resolved before the DRA issued its order.
