Landlord Relocated Storage Space

Tenant complained of a reduction in services based on landlord's relocation of a storage space. The DRA ruled for tenant and gave her a permanent rent reduction. Landlord later asked the DRA to restore tenant's rent based on the DHCR's approval of landlord's application to modify services. The DRA ruled for landlord and restored tenant's rent. Tenant appealed and lost.

Landlord later asked the DRA to restore tenant's rent based on the DHCR's approval of landlord's application to modify services. The DRA ruled for landlord and restored tenant's rent. Tenant appealed and lost. Once the DHCR approved landlord's application to modify services by relocating the storage space, the reduction in services was no longer in effect. At that point, as a matter of law, landlord wasn't required to comply with the prior rent reduction order.
