Landlord Proved Cost of New Equipment

Tenant complained of a rent overcharge. Landlord claimed that apartment improvements were made. As proof, landlord submitted a contractor's bill for over $18,000, marked ``paid in full'' by the contractor. The DRA asked landlord for further proof of the work done. Landlord submitted none. The DRA ruled for tenant and disallowed any rent increase for the improvements. Landlord appealed, and the DHCR ruled that landlord was entitled to an increase for some of the improvements.

The DRA ruled for tenant and disallowed any rent increase for the improvements. Landlord appealed, and the DHCR ruled that landlord was entitled to an increase for some of the improvements. The invoice that landlord had submitted was sufficient to show the cost of some of the improvements landlord had made. DHCR's Policy Statement 90-10 states that an invoice receipt is adequate if marked ``paid in full'' and if issued at the time the work was completed. A DHCR inspection had also confirmed the installation of new bathroom and kitchen equipment, a new entrance door, new windows, and a new wood floor.
