As proof, landlord showed canceled checks, contracts, and itemized cost sheets. The DHCR ruled for landlord. Landlord had submitted to the DRA copies of a $9,000 proposal from a plumbing and heating company, along with a canceled check in the same amount. Both were dated the same day, prior to tenant moving into the apartment. So the work had been done when the apartment was vacant.
