Landlord Offered Tenant Two-Year Lease Option

Tenant complained that landlord didn't offer him the option of a one- or two-year stabilized lease when he moved into the apartment. Tenant had a one-year lease. The DRA ruled for tenant and ordered landlord to give him a two-year lease. Landlord appealed, claiming that tenant was offered both but that landlord offered tenant a reduced rent as an incentive to take a one-year lease. The DHCR ruled for landlord.

Landlord showed that it attached a rider to tenant's lease telling tenant what prior tenant's rent was, told tenant to call DHCR for further information, and later renewed the lease at a reduced rate.
