Landlord Must Provide Garage Door Opener

Tenant complained of a reduction in services. Tenant rented two rent-stabilized garage spaces in the building's garage. Tenant claimed landlord should provide a garage-door opener, but landlord refused to do so. Landlord argued that the garage had a key lock. Tenant said he was never given a key. The DRA ruled for tenant, noting that tenant had a garage-door opener in the past. Landlord appealed, claiming it had never paid for a garage-door opener in the past. The DHCR ruled against landlord. Tenant proved that a garage-door opener had been provided in the past at no additional charge. So it was a required service.
