Landlord Gets Increase for New Windows

Landlord applied for MCI rent hikes based on the installation of new windows building-wide. The DRA denied landlord's application because it was done in two parts over a 14-month period. Landlord appealed, and the DHCR granted the rent hike. Landlord intended a building-wide project. Considering all the circumstances---including the size of the building, the fact that landlord used the same contractor for both jobs, and landlord's funding problems---the window replacement qualifies as an MCI.
