Landlord Gets Increase for New Windows

LVT Number: 12598

(Decision submitted by James R. Marino of the Manhattan law firm of Kucker Kraus & Bruh, LLP, attorneys for the landlord.) Landlord applied for MCI rent increases based on the building-wide installation of new windows. The DRA ruled for landlord, and tenants appealed, claiming that the old windows were 15 years old, not 50 years old as claimed by landlord. The DHCR ruled against tenants. Land- lord submitted a proper application for MCI increases. Tenants didn't prove that the useful life of the prior windows had expired.
