Landlord Fined for Failing to Post Recycling Notice

DOS issued a violation notice to landlord for failing to post a recycling notice in its apartment building. The building contained nine or more dwelling units, and the DOS inspector noted that no signs were posted in a public area to inform tenants of proper recycling procedures. Landlord argued that there were sanitation stickers and notices throughout the building and outside in the receptacle areas, indicating to all tenants the proper procedures for separating their recyclables and nonrecyclables into containers. The ALJ ruled against landlord and fined it $100.

The ALJ ruled against landlord and fined it $100. Landlord appealed and lost. Landlord had submitted a photograph date and time stamped shortly before DOS issued the violation. This photo showed that there were recycling notices in the building. Landlord claimed that the building super routinely took photos when he finished his morning cleaning. The ALJ and ECB didn't believe landlord and disregarded the photograph.
