Landlord Proved Recycling Signs Posted

DOS issued a violation notice to landlord for not posting recycling signs in the building. Landlord claimed that the signs were posted. He said the building was locked, so the DOS inspector couldn't have seen the signs. The ALJ ruled against landlord and fined him $25. Landlord appealed and won. Landlord had produced the signs at the hearing before the ALJ and also produced a letter sent to tenants in April 1998 describing the location of the signs and asking tenants to read them and understand what must be recycled.
