Landlord Didn't Include Invoices with Answer

Tenant complained of a rent overcharge. The DRA ruled for tenant, based on landlord's failure to submit a complete rent history. Landlord appealed, claiming that the DRA hadn't included the cost of new equipment in tenant's first rent. The DHCR ruled against landlord. Landlord submitted no invoices or other proof of any new equipment with its brief answer to tenant's complaint. Landlord's claim that it had submitted documentation to the DRA wasn't believable.

In addition, the items in question were ordered and installed after tenant moved into the apartment and without tenant's written consent. So landlord wasn't entitled to a rent increase anyway.
