Landlord Didn't Clear HPD Violation

Tenants complained to the DHCR of inadequate hot water at their building. The DRA ruled for tenants and reduced their rents. Landlord appealed and lost. Landlord claimed that hot water violations issued by HPD were resolved on the same day they were issued, and that there were no further hot water problems in tenants' apartments. Tenants disputed this, claiming that there was no hot water on at least 27 days between Oct. 26, 2009, and July 12, 2010. When the DRA notified landlord of tenants' complaint, it gave landlord five days to submit proof that the HPD violations had been revoked.
