Landlord Couldn't Produce Records Upon Sprinkler Inspection

The Fire Department issued two violation notices to landlord, one for failure to produce records for the building's sprinkler system and the other for failure to produce a Certificate of Fitness for the system. The ALJ dismissed the violations based on landlord's proof that regular sprinkler inspections were done at the building.

The Fire Department appealed and won. The charges were based on landlord's failure to produce the records of its sprinkler inspections when the Fire Department appeared at the building, not upon a failure to maintain the records. Based on landlord's presentation of proof of compliance with recordkeeping requirements at the first scheduled hearing, reduced penalties totalling $1,100 were imposed.
