Tenant complained of a rent overcharge. The DRA ruled against tenant, and tenant appealed. The DRA had allowed a rent increase based on kitchen renovations which landlord claimed cost $56,000. Tenant claimed the value of the work done was only $44,000. The DHCR ruled against tenant. Landlord wasn't required to make improvements at the lowest possible cost. With the exception of $480 claimed for kitchen ceramic tiles, landlord proved all of its costs through invoices and canceled checks.

The DHCR disallowed the $480 previously approved by the DRA, but otherwise affirmed the "1/40th'' rent increase.
