Landlord applied for MCI rent hikes based on the installation of a parapet wall. The DRA ruled for landlord. Tenant appealed, claiming that the roof leaked and that the building's co-op shareholders should pay for the MCI. The DHCR ruled against tenant. Landlord properly proved the cost, and tenant didn't complain of any leaks in response to landlord's application. The one tenant who did complain of a leak was exempted from the MCI increase until the condition was fixed.
