Gas Piping and Wiring Installed with New Burners

Landlord applied for MCI rent hikes, based on the installation of three gas/oil burners. The DRA granted landlord's application in part---disallowing the cost of related repairs and maintenance and a chain link fence. Landlord appealed, claiming that the costs of gas piping, miscellaneous wiring, and a chain link fence---required by Brooklyn Union Gas Co. to enclose the gas meters---were all directly related to installation of the burners. The DHCR ruled for landlord in part.

They should have been included in the DRA's calculation of the MCI increase. But the chain link fence didn't qualify.
