Gas Line Replacement Directed by Con Ed

Landlord applied for MCI rent hikes based on the installation of a new gas line. The DRA ruled for landlord, and tenant appealed. Tenant claimed that the gas line work was repair work directed by Con Edison. The DHCR ruled against tenant. Landlord admitted in its application that the gas line and mains were replaced based on an emergency shutdown by Con Edison. This didn't bar landlord from collecting rent hikes for work that qualified as an MCI.
