No Increase for Extra Gas Lines Installed During Repiping

Landlord applied for MCI rent hikes based on the installation of water and gas repiping. The DRA ruled for landlord. Tenants appealed and won, in part. Tenants pointed out that two of the installed gas lines and meters didn't benefit tenants. Landlord had installed these extra lines and meters in two apartments that each were currently combined into one apartment. Landlord argued that it installed an extra gas line and meter in each of these units because, in the future, the apartments could be reconfigured again as two apartments.

The DHCR agreed that the two extra gas lines didn't serve any purpose and disallowed a portion of the MCI increase attributable to them.
