Fumes and Odors Entered Tenant’s Apartment from Bakery

Tenant complained of a reduction in services. The DRA ruled for tenant and reduced tenant’s rent based on fumes and odors in tenant’s apartment. Landlord appealed and lost. Landlord claimed that the outside air vent near tenant’s window was sealed, that the vent was installed in compliance with building and fire codes, and that there was no violation on record.

Tenant complained of a reduction in services. The DRA ruled for tenant and reduced tenant’s rent based on fumes and odors in tenant’s apartment. Landlord appealed and lost. Landlord claimed that the outside air vent near tenant’s window was sealed, that the vent was installed in compliance with building and fire codes, and that there was no violation on record. But DHCR inspection showed that there were fumes and odors entering tenant’s apartment from the building’s ground-floor bakery. So landlord wasn’t maintaining required services.
