Expired Boiler Registration

LVT Number: 13761

DEP issued a violation notice to landlord based on an expired boiler registration. Landlord showed that there was a valid registration for periods before and after the violation date. But there was no valid registration in effect on the violation date, so the ALJ ruled against landlord and fined it $350. Landlord appealed and lost. Landlord was required to renew its boiler registration every three years. It was no excuse that landlord didn't get a courtesy renewal notice from DEP and didn't realize that the boiler registration was about to expire.
