Landlord Operated Boiler with Expired Certificate

DEP issued a violation notice to landlord on Dec. 30, 2014, for using a boiler without an operating certificate. The operating certificate on record had expired on Oct. 31, 2013. Landlord argued that it had filed an application to convert from #6 to #4 fuel oil on Dec. 27. But landlord didn’t submit the approved permit to DEP until Jan. 20, 2015. The ALJ fined landlord $350. Landlord appealed and lost. Landlord never informed DEP of the proposed fuel oil conversion prior to issuance of the violation.
