Elevator Dismantled in 1951

Tenants complained of a reduction in building-wide services. They claimed that one building elevator was completely closed and that the other elevator broke down often. An inspection showed that one elevator was inoperative, but that the other one functioned. The DRA reduced tenants' rents based on the inoperative elevator. Landlord appealed, arguing that the inoperative elevator wasn't a required service because it was dismantled in May 1951. Landlord submitted orders from the City Buildings Department as proof.

The DHCR found that since the elevator wasn't operating on May 31, 1968, the rent stabilization base date, it wasn't a required service. The DHCR had also issued prior orders concerning this building stating the same thing.
