Dirty Hallway Not Minor Condition

Tenants complained of a reduction in building-wide services. The DRA ruled for tenants and reduced their rents. Landlord appealed. Among other things, landlord claimed that the dirty hallway cited in the DRA's order was a minor condition and didn't warrant a rent reduction. The DHCR ruled against landlord. Dirty public areas are only considered a minor condition when the area in question is a specific one and other areas of the building are being properly maintained.

In this case, there were two different inspection reports stating that the public areas in three different places were dirty.
