DHCR Permits Landlord to Convert Elevator to Automatic

Landlord asked the DHCR for permission to modify essential services. The DRO ruled for landlord, granting its application for permission to convert a manually operated elevator to an automatic elevator. Tenant appealed and lost. Tenant claimed that only two of the three lobby elevators were regularly used as passenger elevators. Tenant also raised claims regarding the number of floors in and the age of the building. But tenant didn’t object to landlord’s application while it was before the DRO, and the DHCR wouldn’t consider any new arguments on appeal.
